He was born in Johnstown, Cambria County, Pennsylvania. He was five years of age when his parents removed to Mount Pleasant, Westmoreland County. There his early education was acquired, and he later matriculated at Washington and Jefferson College, where he remained until the close of his sophomore year. He then taught school for one year in Jefferson County, after which he went to Greensburg and took up the study of law under the preceptorship of Joseph A. McCurdy. He was admitted to the bar September 26, 1893, and directly afterward the law firm of McCurdy & Cunningham was formed, which partnership existed for over ten years.
He was an ardent supporter of the Republican party in politics; was chairman of the Republican county committee in the campaigns of 1897 and 1898, and in the autumn of 1900 was elected to the office of district attorney of Westmoreland county, to which office he was re-elected in the fall of 1903. At the centennial celebration of Washington and Jefferson College in 1903, the honorary degree of Master of Arts was conferred on Mr. Cunningham by the college. He was a charter member of Westminster Presbyterian Church, and a member of the Masonic bodies located in Greensburg.

He was admitted to the Westmoreland County Bar September 26, 1893; was District Attorney of Westmoreland County for two terms; later appointed Deputy Assistant Attorney General of Pennsylvania and still later Assistant Attorney General, and was conspicuous in the prosecution of the "Grafters" at Harrisburg and in the investigations about the horrible lynching at Coatsville.
